This petition was submitted, by Palestinian residents of the area, on January 11th 2013. The petitioners requested that the court prevent the authorities from removing a cluster of tents, pitched by the petitioners, in an area near Ma’ale Adumim, also known as the “E1” area.
The court in turn gave a temporary injunction preventing the removal of the tents unless such a removal was needed for security reasons. As such a need arose on January 13th, 2013, the residents of the tents were removed by a “restricted area” order, an order which left the tents in place.
On January 16th, 2013 the authorities requested, of the court, to lift the injunction thus permitting the removal of the tents. The authorities’ position was that such a removal was needed in order to maintain the peace and security, and to prevent illegal construction, in the area.
Additionally, the authorities’ position was that, the special circumstances, since the illegal building in the area was stopped at its beginning, the tents may be seized as an accessory to future offence.
The court accepted the authorities position, lifted the injunction and allowed the seizing of the tents left in the area, which in turn were taken to the impound yard.
Currently, the authorities are composing a response, to the part of the petition regarding the construction of a tourism site, where the tents previously stood.
