On February 26th, 2013 the Israeli HCJ ruled on a petition submitted by a resident of Judea & Samaria to have the body of his brother, who had passed away in a prison in Ashkelon in the early 1980’s, turned over to him.

The petition claimed that the body was being held by the Israeli authorities and that the IDF had information as to its whereabouts but refused, allegedly, to turn the body over.

After extensive efforts to locate the burial site of the petitioner’s brother, including opening graves marked as “empty” in the “Enemy Dead” cemetery and double checking the records of “unidentified” bodies, the court was satisfied that all possible steps were taken to try and locate the allegedly missing body and therefore decided to erase the petition.
