The petitioners in HCJ 146/14, the city council of Salfit, requested that the time period during which one may challenge building plans in Judea & Samaria begin counting down from the date the plan is published on the Ministry of the Interior’s website, this in contrast to the current practice whereby the countdown begins upon publication at the Civil Administration or the Regional Councils. The petitioners claimed that Palestinian’s access to such publications is limited and therefore the current practice should be changed.

The state in turn argued that the area’s law only requires publication to be done in print media and that in reality access to the plans is unrestricted to all persons.

On September 29th the HCJ rejected the petition accepting the states position in full. The court further stated that the area’s authorities had gone above and beyond what the law requires by giving the petitioners a number of extensions to file a challenge to the building plan.
